Terms & Conditions

These Terms constitute a legally binding agreement between you and AdaptivePrep. By registering for an account, subscribing to a plan, or otherwise using the Service, you represent that you are at least 18 years old (or the age of majority in your jurisdiction) and that you have the legal capacity to enter into this agreement.

AdaptivePrep is an adaptive exam preparation platform designed to help individuals study for the CISSP (Certified Information Systems Security Professional) examination. The Service delivers computer-adaptive practice tests, domain-level performance analytics, and study guidance based on the ISC2 CISSP exam domains.

AdaptivePrep is an independent study tool and is not affiliated with, endorsed by, or sponsored by ISC2 or any other certification body. Passing AdaptivePrep practice tests does not guarantee passing any official examination.

You are responsible for maintaining the security of your account and password. AdaptivePrep cannot and will not be liable for any loss or damage resulting from your failure to comply with this security obligation. You must notify us immediately at support@adaptiveprep.app if you become aware of any unauthorized use of your account.

You may not use another person's account without permission, or share your account with others. Each subscription is for individual use only.

The Service is offered on a subscription basis. By subscribing, you authorize us to charge your payment method on a recurring basis for the subscription period you selected (monthly or annually). Subscriptions automatically renew unless canceled before the renewal date.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; you will retain access to the Service until then. We do not provide prorated refunds for partial billing periods, except where required by applicable law.

We reserve the right to change subscription pricing at any time. We will provide at least 14 days' notice before any price increase takes effect for existing subscribers.

You agree to use the Service only for lawful purposes. You may not:

• Use the Service to violate any applicable laws or regulations.
• Attempt to gain unauthorized access to any part of the Service or its underlying infrastructure.
• Use automated scripts, bots, or scrapers to extract content from the Service.
• Post, transmit, or distribute content that is unlawful, harmful, offensive, or infringes the rights of others.
• Use the Service to transmit spam, phishing emails, or unsolicited communications.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to circumvent any subscription or access controls.

Violation of these acceptable use provisions may result in immediate termination of your account.

The Service and all of its content — including practice questions, explanations, algorithms, domain analysis logic, user interface design, trademarks, and branding — are the exclusive property of AdaptivePrep or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited license to use the Service for personal study purposes only. No content may be reproduced, republished, transmitted, or distributed in any form without our express written consent.

The Service may integrate with or link to third-party services (such as Google and GitHub for authentication, and Stripe for payment processing). Your use of third-party services is governed by their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADAPTIVEPREP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS; (C) ANY BUGS, VIRUSES, OR SIMILAR THAT MAY BE TRANSMITTED THROUGH THE SERVICE.

OUR AGGREGATE LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS.

You agree to defend, indemnify, and hold harmless AdaptivePrep and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the effective date and, where appropriate, by sending an email notification. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

We reserve the right to terminate or suspend your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

These Terms shall be governed by the laws of the State of California, United States, without regard to conflict of law principles. You agree to submit to the personal jurisdiction of the courts located in California for any disputes arising from these Terms or your use of the Service.
