End User License Agreement

Subject to your compliance with this Agreement and payment of any applicable subscription fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal, non-commercial exam preparation purposes.

You agree that you will not:

• Copy, reproduce, distribute, or publicly display any content from the Service without our written permission.
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Service.
• Use automated tools (scrapers, bots, crawlers) to extract questions, answers, or any Service content.
• Share your account credentials or allow any other person to access the Service through your account.
• Resell, sublicense, or otherwise commercialize access to the Service or its content.
• Use the Service in any manner that could damage, overburden, or impair our infrastructure.
• Remove or alter any proprietary notices or labels on the Service.

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. We reserve the right to suspend or terminate accounts that contain false information or are used in violation of this Agreement.

Access to certain features of the Service requires a paid subscription. By subscribing, you agree to pay the fees applicable to your chosen plan. Fees are billed in advance on a recurring basis (monthly or annually, depending on your selection). All fees are non-refundable except as required by applicable law or as expressly stated in our refund policy.

We reserve the right to change subscription pricing upon reasonable notice. Continued use of the Service after a price change constitutes your acceptance of the new pricing.

All content available through the Service — including but not limited to practice questions, explanations, domain analyses, software, text, graphics, and user interface elements — is owned by or licensed to AdaptivePrep and is protected by applicable intellectual property laws. Nothing in this Agreement transfers any ownership rights to you. Your right to use the Service is limited to the license expressly granted in Section 1.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT GUARANTEE THAT USE OF THE SERVICE WILL RESULT IN PASSING ANY EXAMINATION.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ADAPTIVEPREP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

This Agreement is effective until terminated. We may terminate or suspend your access to the Service immediately, without prior notice, if you breach any provision of this Agreement or if we reasonably believe your use poses a risk to other users or to the integrity of the Service.

You may terminate this Agreement at any time by canceling your subscription and deleting your account. Upon termination, your license to use the Service will immediately cease.

This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively in the state or federal courts located in California.

We reserve the right to modify this Agreement at any time. We will provide notice of material changes by updating the effective date at the top of this page and, where appropriate, by sending an email to your registered address. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Agreement.
